ENGINEERING SAMPLES POLICY

SECO offers Engineering Samples for early evaluation and development. Engineering Samples are pre-production products that may have not yet completed engineering development of hardware, software, firmware, or other technical aspects of the product, and for which product verification, regulatory compliance, and quality procedures may have not yet been completed.

SECO has a rigorous product development process which defines maturity of the product. All products made available prior to passing the ATO (Available to Order) gate are considered to be Engineering Samples.

Intended Usage

Because Engineering Samples have not completed all design, verification, and quality activities, SECO limits their use exclusively to evaluation, test, development, and prototyping purposes. Deployment as a part of a product, including for use in pre-production qualification and certification testing is strictly prohibited, as functional limitations and unpredictable and uncorrectable errors may occur. When purchasing Engineering Samples, the customer inherently agrees to these terms and limitations. The customer assumes all risk and liability for any violations of these terms and conditions and agrees to indemnify SECO for any legal action that results from such violations.

Engineering Samples are sold “as-is” with no warranty of any kind, neither explicit nor implied. SECO does not warrant that Engineering Samples are fully tested, verified, or will operate in accordance with datasheet specifications. In absolutely no case will SECO be held liable for any direct, indirect, incidental, or consequential damage to property or persons resulting from improper usage of Engineering Samples.

SECO does not guarantee that Engineering Samples will provide any particular functionality or will meet the requirements of a particular user application. SECO does not warrant that Engineering Samples are error-free, nor does it make any other warranties, expressed or implied, statutory or otherwise, including, but not limited to, implied warranties of merchantability, adaptability to a particular purpose, or non-infringement.

Long term maintenance

The product associated with Engineering Samples is subject to change during completion of the product development process. Therefore, Engineering Samples may not be form, fit, and function equivalent to the production-grade product. The customer assumes all technical, financial, and schedule risk associated with such form, fit, and function changes. Engineering Samples are not eligible for long-term maintenance or any kind of warranty. SECO disclaims any obligations for technical support or bug fixes.
