  • Directive 2002/58/EC, as updated by Directive 2009/136/EC,

  • art. 13 of Decree 196 dated June 30, 2003,

What are Cookies?

Cookies are small text files that are installed on computers, smartphones and tablets as a consequence of web browsing. The websites visited send the cookies to the browser used (e.g. Internet Explorer, Mozilla Firefox, Google Chrome, Safari, Opera), which stores them and makes them available to the websites concerned on the user's next visit. Cookies may also be sent to the user's browser by other websites or web servers i.e. by third parties. This means that, while browsing, a given website may contain elements from other websites that include these cookies, such as images, sounds, maps and links to other pages.

Depending on the type of cookie and, therefore, the reason for which it is installed, certain user data is stored for specific purposes, e.g. to make use of the website more effective, activate specific functions, monitor each session etc.

In particular, cookies can remember the user's preferences, avoid repeated input of the same information during browsing (e.g. username and password), and analyze use of the website's services and content, in order to optimize the browsing experience and the services offered.

Types of Cookie

There are two macro-categories of cookie:

  • Technical Cookies, which are normally installed by the owner or administrator of the website in order to “send a communication on an electronic communications network or, to the extent strictly necessary, to enable the company's service provider to deliver the information explicitly requested by the subscriber or the user of that service” (see art. 122, para. 1, of the Privacy Code).

The installation of Technical Cookies does not require prior consent from the users concerned.

There are various types of Technical Cookie:

  •
    • Transient cookies or session cookies, which ensure normal browsing and use of the website; for example, they enable the user to make a purchase or authenticate access to private areas of the website. These cookies are not stored on the user's device on a persistent basis and are erased automatically when the browser is closed. Their use is linked to transmission of the identification data needed to allow safe and efficient browsing of the web pages. Session cookies do not allow the user's personal identification data to be obtained in any way.

    • Analytics cookies, which are used to gather information on use of the website in an anonymous form, and to obtain a statistical analysis of page views and the behavior of users. This anonymous analysis provides information and suggestions for improving the quality of the website and making more readily accessible the content most searched for and, therefore, of greatest interest to users. Analytics cookies may be sent by the website or by third-party domains and do not allow the user's personal identification data to be obtained in any way. Even if they gather data in anonymous form, analytics cookies installed by third parties are treated as profiling cookies by the Italian Data Protection Authority.

    • Function cookies, which are considered to be technical cookies when used by the administrator of the website to gather aggregated information about the number of users and how they visit the website. These cookies allow the user to browse based on selected criteria (e.g. language, products selected for purchasing), in order to improve the service provided to the user.

  • Profiling Cookies, which create profiles of the user in order to send advertising messages that are consistent with the preferences shown while browsing the web. European and Italian regulations establish that adequate information must be provided to users about the installation of profiling cookies for the above purpose, so that consent can be given. In particular, art. 122 of the Privacy Code makes reference to them when stating that " the storing of information on the device of a subscriber or user, or the accessing of information already stored, is only allowed on condition that the subscriber or user has given consent after being informed on the simplified basis envisaged in art. 13, para. 3, of the Privacy Code".
